Government Adopts Bill on Arbitration

The government adopted on Thursday a bill on arbitration, which will help decrease the workload of courts, State Secretary at the Justice Ministry Robert Marolt told the press. The bill speeds up and specifies procedures in more detail as well as provides better legal security for parties involved.

The bill regulates all possible kinds of arbitration irrespective of the content or parties to the arbitration - it does not matter if they are from Slovenia or from abroad.
Currently, arbitration is regulated by two separate documents; the Slovenian civil code and private international law, which regulates international arbitration procedures.
Marolt said that the bill would do away with the unclarities arising because the field is regulated by two different documents.
The arbitrator's decision is binding for the parties to the procedure, Marolt said. The arbitration procedures do not take place in courts, therefore the bill is expected to reduce the caseload at the country's courts.
